TM,
You said unless proven otherwise....
Well if you Google "Lorayne Churchwell" you will come up with this page http://www.google.com/search?q=lorayne+ ... S:official

showing that indeed two of my tricks are in books under my name. The rest of the searching I will leave up to you. See if you can find the book that is written about me and my former girlfriends life story. Almost like a David Blaine treasure hunt except no treasure at the end.

I am aware that many people have opinions of people, some not always good. But thats ok.
As far as copyrighted material, I do not know any material written that says "Do not teach this effect to other magicians."

McDermott, thanks for the passionate reply but lets try and keep this from being a slagging match and try and accomplish what we want here (ie to raise everybody's awareness of what a charlatan this man is) rather than what he want's here (to rile us into a heated frenzy).

Tarquin, answer the questions put to you.

Then I shall withdraw the word "wannabe".

On your site it is mentioned that your previous exposure site was shut down due to some legal complications. You confirm that yourself. What makes your current forum different?

Ah, I see you have an effect published in Apocolypse. Do I need to purchase the book or will you tell me how to do it for free?

Tarquin. The Banachek PK Touches exposure is a verbatim copy of Banachek's Psychokinetic Touches manuscript. That's an infrigement of copyright. That is illegal. It's a plain and simple criminal matter.

I was going to waste a whole lot of my time cutting and pasting quotes with my replies, but I decided against. I'm too busy to deal with this reasonably, especially when in the face of an unreasonable cancer on our magic community, to wit, Tarquin.

Anyone who claims to be great, like you do sir, is usually a hot air bag. And, since you and your ilk are a cancer, even if your talent was great and you were hugely successful, you'd still be a cancer.

As Huw has pointed out, this is a criminal subject, not up for debate. You are breaking international copyright laws and, while you may be a member in good standing of every magic site in the universe, you are still a criminal and a cancer.

Figure it out.

Mike.

TM,
You seem to know a lot of what is on my site up to last week. I am guessing that you are still a member there benifiting from the site or are you going to be like Huw and say you don't read any of it.

Huw. I have looked and looked for that Banacheck article and can't find it. Please pm it to me so I can put it on the site.

Micheal Jay. You the easiest to answer; you don't say nice things about anybody unless it's about yourself so I'm not paying attention to you either.

Someone mentioned that my site was closed for legal reasons and claims to be a member of my site and says that whats I wrote on it?
No, it wasn't closed for legal reasons. It was closed by msn because Ellusionist threatened legal action against MSN and MSN not knowing that you cannot copyright a trick put the site on hold till they could figure it out. Well we waited for it to open again and meanwhile opened a new site that I bought. DBS was opened again but since we had a new site we closed it down and just kept with the new site that I bought. Now Ellusionist complains and threaten me about copyrights and so far me and my lawyers have won the argument against them and every magicians and production company that has tried to come against the site. Thats right, we have proven each time that there is no copyright against magic each time and each time my site has been the winning side.
So if Micheal Jay wants to think I am a criminal, then its just Jay and his imaginary thinking.

Gee, Tarquin, that would hurt if you were worthy of even the most miniscule amount of respect.

Mike.

Ah, what a droll sense of humour you have, Tarquin!

The full manuscript is on your site and well you know it. Banachek owns the copright to that manuscript. Your protestations that you are doing nothing illegal are completely phoney. Let me say it again in the hope that it may eventually sink in: you are illegally publishing copyrighted material. That is a criminal offence. This is not ambiguous or open to debate. You are engaged in the criminal redistribution of copyrighted material.

You said earlier: "As far as copyrighted material, I do not know any material written that says "Do not teach this effect to other magicians." Well, do you know anything at all about the laws of copyright? If not, perhaps now would be a good time to start studying.

Huw

Note: I did not come here to advertise my site but it seems the side effects of this discussion is many of your members are pm'ing me wanting to be a member.

Your forum has a Search facility. Use it.

Maybe they are people who have books in print who are interested in seeing if they've been copied onto your site?

Just as with any cancer, it grows. Thank you for stating that and proving my point better than I ever could.

Mike.

Tarquin,

I agree with EVERYONE else on this thread, your exposure site is wrong.

I don't care how much money you have made from your "professional" work, because, money isnt everything, I've worked with famous people and been paid a fair amount of money for it, but, hell, the money isnt what its about, its the performing that i care about most, and if someone who knows real talent say something nice, then thats more than enough.

I will NEVER go on exposure sites, because that type of work is . If your such a brilliant magician, then why would you completely trash what other fellow magicians have put years and years of work into. To respect them, i would pay for their products, because, at the end of the day, they deserve it, every lest penny.

And i also would like to say the same as Andy C, if i ever get wind that you are at ANY magic convention that i am at, i will personally tell you how great i think you are, as loudly as possible.

Congratulations on becomeing the most arrogant prick i have ever heard of.

Mark

No, I'm not a member of your site nor have I ever visited it before. It took me only a couple of minutes to browse your site as a guest and find the mentioning about your previous sites.

Although it is difficult to apply copyright laws in the field of magic, the law does favor the owner. According the U.S. Copyright Office, even "pantomimes and choreographic works" are protected, as long as they're recorded or written. As I see it, even if you were describing a magic routine in your own words but without a permission from the author, you would still be infringening the copyright, making it illegal.

Of course, that is quite a strong view but basically it presents that almost anything can be copyrighted.
